① In this Agreement, "NOS" refers to the software developed or produced by INCA Internet Corporation over which the company holds copyrights, ownership, and other rights. “NOS” may include the software, media, printed materials, online or electronic documentation, and all accompanying executable files, add-ons, user manuals, help files, and any other files.
② In this Agreement, "Device" means an information processing unit capable of transmitting and receiving information over a communication network, such as a server computer, client computer, or mobile terminal.
③ In this Agreement, "Use" refers to all actions that install, run, or display “NOS” on the user's device.
④ In this Agreement, "Supplier" refers to distributors, resellers, or any entity that has entered into a business partner agreement with INCA Internet Corporation for the sale of “NOS,” or has been granted official sales authorization by INCA Internet Corporation.
⑤ In this Agreement, "You" or "User" refers to an individual or organization that has entered into a contract (hereinafter “Purchase Agreement”) with INCA Internet Corporation or a supplier for the license to use “NOS.”
① Limited License
INCA Internet Corporation grants the user a non-exclusive, non-transferable license to use NOS during the license period, provided that the user agrees to the terms of this Agreement.
① Prohibition of Transfer, etc.
The user may not transfer the right to use NOS or assign the contractual position related to the acquisition of the NOS license to any third party, nor provide it as collateral, without the prior written consent of INCA Internet Corporation. Exceptionally, if the user transfers the rights to NOS or provides it as collateral, the user shall no longer retain any copies of NOS and must deliver all materials related to NOS, including this Agreement, product keys, media, manuals, and upgrade versions, to the transferee. The transferee must agree to all terms of this Agreement. Under no circumstances may the user divide and transfer a portion of the rights acquired under this Agreement. All liabilities arising from any violation of this restriction on transfer shall rest solely with the user, and INCA Internet Corporation bears no responsibility whatsoever in this regard.
① NOS Services
NOS provides a variety of online integrated security services to protect user devices from hacking threats, including keyboard security, malicious code detection, network protection, and detection of security-vulnerable software.
② Internet Connection
To operate properly, NOS requires a stable internet connection. The user is responsible for ensuring continuous and stable internet connectivity at all times.
③ Updates
NOS includes functionality that communicates via the internet as part of its normal operation to perform automatic updates. When NOS is automatically updated, necessary files may be installed on the user’s device without separately requesting the user’s consent, as such consent is deemed to have been granted by agreeing to this Agreement. The method of automatic updates may change at any time to enhance urgent or real-time updates for the user's device. In the event of a security emergency such as the spread of malicious code, data from a user’s temporary update files may be transmitted to other users whose systems have not yet been updated, allowing prompt updates.
④ Additional Services
INCA Internet Corporation may provide users with additional services beyond the basic NOS services during installation or updates. By installing or updating NOS, the user is deemed to have agreed to receive such services.
⑤ Blocking Prevention
If the functions or settings of NOS are altered or obstructed by external products or services, INCA Internet Corporation may implement technical measures to prevent or resolve such interference. External products or services that interfere with NOS’s operation may be defined as malicious code.
⑥ Preventive Measures
In compliance with relevant laws and at the request of the Korea Internet & Security Agency, INCA Internet Corporation may provide necessary services such as malicious code removal, vulnerability checks, and technical support to prevent and contain security incidents.
① Information Collection
INCA Internet Corporation may collect the following information through NOS to protect the user's device and to improve the quality and performance of NOS. INCA Internet Corporation complies with the Personal Information Protection Act and other relevant laws and will not transmit or disclose the collected information to any external parties.
a. Service usage records, access logs, cookies, and access IP information
c. Data sample information sent in response to potential security threats
d. Information on applications downloaded through web browsers or similar means
e. Diagnostic information on malicious code
f. Site usage information through web browsers
g. Other non-personally identifiable data necessary to protect the user’s device
② Others
INCA Internet Corporation may collect non-personally identifiable data such as the version and error information of the product in use to support and improve the quality of NOS. Additionally, exposure counts and click counts of banners embedded in NOS may be collected for statistical purposes. Data collected related to banners are used temporarily for statistical analysis and will be discarded after use, and therefore are not stored.
① Holder of Intellectual Property Rights
NOS is protected under copyright law, other laws related to intellectual property, and international copyright treaties. The user is granted only a non-exclusive right to use NOS; all patent rights, copyrights, and other intellectual property rights (hereinafter “Intellectual Property Rights, etc.”) in and to NOS belong to INCA Internet Corporation. Accordingly, no Intellectual Property Rights, etc. are transferred to the user as a result of the installation or use of NOS, and the license granted under this Agreement shall not be construed as a transfer or sale of such rights. All rights to NOS remain with INCA Internet Corporation.
② Prohibition of Infringement
In principle, the user may not commit any act that infringes upon the Intellectual Property Rights, etc. of INCA Internet Corporation in relation to NOS, nor create derivative works based on NOS. The user may not remove any ownership notices, marks, labels, or other intellectual property notices from NOS. Except as expressly permitted under this Agreement, the user shall not reverse engineer, decompile, or disassemble NOS; nor translate, redistribute, retransmit, publish, sell, lend, lease, trade, resell, pledge, offer as security, transfer, modify, alter, or extend any part or all of NOS without prior written consent from INCA Internet Corporation. Any reproduction or redistribution of NOS in violation of this Agreement may constitute copyright infringement and subject the user to civil or criminal liability.
① Use of Open Source Software
NOS may contain specific software or libraries that utilize open source software. In such cases, licenses for the open source software are granted to the user in accordance with their own applicable license terms.
② Open Source Software License Terms
The individual license terms, related documents, other materials, and copyright notices for open source software can be found in the license file located in the installation folder of NOS or on the INCA Internet Corporation open source site indicated in the license file. These may be changed at any time by the licensors without separate notice. In the event of a conflict between the license terms of the open source software and this Agreement, the license terms of the open source software shall prevail, but only to the extent of such conflict. The user may receive copies of the open source files via the INCA Internet Corporation open source site recorded in the license file in accordance with the license terms (If a copy of an open source file cannot be posted on the website due to circumstances, it may be requested through the contact information provided in this Agreement).
③ Disclaimer Related to Open Source Software
Although open source software is distributed for the purpose of useful use, it is provided without any warranty, including implied warranties of merchantability or fitness for a particular purpose. The licensors of the open source software, INCA Internet Corporation and suppliers shall bear no responsibility for any damages arising from the user's use of the open source software, even if they were aware of the possibility of such damages, to the maximum extent permitted by applicable law.
① Disclaimer of Warranties
The user bears all risks associated with the use and performance of NOS and related customer support services (including those due to the user's failure to update the engine properly). To the fullest extent permitted by applicable law, INCA Internet Corporation and/or suppliers disclaim all express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights. INCA Internet Corporation does not warrant that the functions included in NOS will meet the user's requirements or that use of NOS will not cause temporary interference or errors in the operation of the device. Furthermore, to the extent permissible under applicable laws, all other warranties that can be excluded are disclaimed. INCA Internet Corporation shall not be held responsible for any issues arising from changes in hardware or device operating systems made after the release of NOS. Additionally, INCA Internet Corporation shall not be liable for any damages resulting from newly discovered viruses or potentially harmful programs after the release of NOS, or in cases where an upgraded version or new product is released and support for older versions has been discontinued.
② Remedies
The sole and exclusive remedy available to the user and the entire liability of INCA Internet Corporation in connection with NOS shall, at the discretion of INCA Internet Corporation be limited to: (i) replacement of the defective NOS, (ii) repair or replacement of NOS that fails to meet the limited warranty of INCA Internet Corporation or (iii) termination of this Agreement and refund of the purchase price (if paid by the user). The user may obtain such remedies by submitting proof of purchase to INCA Internet Corporation within the warranty period.
③ Limitation of Liability
Regardless of whether the remedies provided herein fulfill their essential purpose, INCA Internet Corporation and/or suppliers shall not be liable, to the maximum extent permitted by applicable law, for any damages arising from the use or inability to use NOS or from the provision or failure to provide customer support services. This includes, but is not limited to, consequential, incidental, indirect, special, economic, punitive, or similar damages; loss of business profits, loss of goodwill, business interruption, malfunction or failure of the device, loss of business information, or any other commercial or monetary damages or losses.
④ Compliance with Applicable Laws
Under the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., NOS may perform security actions such as malicious code treatment and vulnerability checks at the request of government-designated specialized agencies. INCA Internet Corporation bears no responsibility in this regard.
① Termination
The user may terminate this Agreement at any time by permanently discarding NOS. This Agreement will automatically terminate if NOS is copied or duplicated without authorization. Upon termination of this Agreement, the user must permanently discard NOS and all copies thereof created by the user. If the Agreement is terminated due to the user's fault, any license fees or other payments made to obtain the right to use NOS will not be refunded.
① Entire Agreement
This Agreement constitutes the entire agreement between the user and INCA Internet Corporation and supersedes all prior written or oral agreements, understandings, representations, advertisements, and notices regarding the essential terms of this Agreement.
② Amendment of Agreement
INCA Internet Corporation amend this Agreement as necessary due to changes in relevant laws or modifications to the software. In such cases, the updated End User License Agreement will be posted on the company’s website and the user will be notified accordingly, providing the opportunity to review and accept or reject the revised Agreement within a specified period. Notifications to users may be made through notices on the website or by email.
③ Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
④ Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the Republic of Korea. Any dispute arising between INCA Internet Corporation and the user in connection with the use of NOS shall be subject to the exclusive jurisdiction of the Seoul Central District Court of Korea as the court of first instance.
